EULA

This Stare Down Match End User License Addendum (“Mobile Addendum”) is between you and Stare Down Match, a Chicky Farm LLC owned application, and governs your use of the Stare Down Match mobile application for iOS.
This Mobile Addendum is an addendum to Stare Down Match’s “Privacy Policy and Terms of Conditions”.

Parties

This Mobile Addendum is between you and Stare Down Match only, and not Apple, Inc. (“Apple”). Stare Down Match, not Apple, is solely responsible for the Stare Down Match iOS App and its content. Although Apple is not a party to this Mobile Addendum, Apple has the right to enforce this Mobile Addendum against you as a third-party beneficiary relating to your use of the Stare Down Match iOS App.

Terms of Service

To use the Stare Down Match iOS App, you will be required to register to receive a “user account”. In doing so, you must accept Stare Down Match’s Privacy Policy and Terms and Conditions.

Privacy Policy

Stare Down Match may collect and use information concerning your use of the Stare Down Match iOS App as set forth in its Privacy Policy.

Limited License

Stare Down Match grants you a limited, non-exclusive, non-transferable, revocable license to use the Stare Down Match iOS App for your personal, non-commercial purposes. You may only use the app as permitted by the Apple App Store Terms of Service.

Content

The iOS app allows you to post customizable content. This content must be family-friendly and suitable for all ages. No offensive, abusive, or adult-themed content will be tolerated. Accounts posting such content will be terminated without warning. Stare Down Match reserves the right to terminate such accounts without warning.

Warranty

The Stare Down Match iOS App is provided on an “as is” basis. Stare Down Match disclaims all warranties about the Stare Down Match iOS App to the fullest extent permitted by law.

Third-Party Intellectual Property

Stare Down Match shall not be obligated to indemnify or defend you with respect to any third-party claim arising out of or relating to the Stare Down Match iOS App.

Product Claims

Stare Down Match makes no warranties concerning the Stare Down Match iOS App. Please see the Privacy Policy and Terms and Conditions sections of Stare Down Match for further understanding.

U.S. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist support” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

EXPORT COMPLIANCE

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations ("EAR") maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control ("OFAC"), and the International Traffic in Arms Regulations ("ITAR") maintained by the Department of State. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

AGE RESTRICTIONS

You affirm that you are at least 13 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with these Terms and Conditions. In any case, you affirm that you are over the age of 13, as the Stare Down Match iOS App is not intended for children under 13.

DATA SECURITY

We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk of unauthorized access, disclosure, alteration, and destruction of personal data. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal data for improper purposes.

IN-APP PURCHASES

In-app purchases may be required for some features of the Stare Down Match iOS App. You agree that all such purchases are non-refundable and you are responsible for all charges incurred through your account, including unauthorized charges.
